Regulations for purchases made within the online store RAVON-MANUFACTURA.COM and the provision of services by electronic means, effective from 20/05/2024.
RAVON-MANUFACTURA.COM is an online store, available in the ravonmanufactura.com domain (hereinafter referred to as "ravonmanufactura.com"), run by FHUP PEGAZ Halina Niewadzi with its registered office in Kraszków, Kraszków 100, 26-300 Opoczno, NIP: 7680001490, REGON: 590059980 (hereinafter referred to as "RAVON-MANUFACTURA.COM"), which Customers can contact at the following e-mail address: sklep@ravonmanufactura.com, via the contact forms available on the ravonmanufactura.com website and by phone at [enter phone number].

1. General provisions
These Regulations define the rules for concluding product sales agreements, placing orders and the rules for providing and using free services offered by RAVON-MANUFACTURA.COM via ravonmanufactura.com for the benefit of Customers. In the scope of services provided electronically, these Regulations are the regulations referred to in art. 8 of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2002, No. 144, item 1204, as amended).

RAVON-MANUFACTURA.COM conducts retail sales electronically via the Internet. Orders are accepted via websites available in the ravonmanufactura.com domain, by e-mail and by phone.

Customers may use ravonmanufactura.com by registering, subject to point 7 below. The provision of services within ravonmanufactura.com is of an indefinite nature. The Customer has the right to terminate the agreement concluded with RAVONMANUFACTURA.COM for the use of ravonmanufactura.com, at any time, by clicking the "Delete account" button located in the Customer's account after logging in, in the "Edit your data" tab. The above does not apply to situations in which RAVONMANUFACTURA.COM is in the process of fulfilling an order placed by the Customer. In such a case, the effect of termination of the agreement will occur at the time of fulfillment of the order in question. Upon deletion of the account, the Customer's personal data are further processed on the basis of art. 70 § 1 of the Tax Ordinance, i.e. 5 years from the end of the calendar year in which the goods were purchased. If the Customer has not made any purchases, or the period indicated in the entry has elapsed, the data assigned to the account will be deleted.

2. Technical conditions
To use the Store’s services, the Customer should use an IT system that meets the following criteria:
a. a computer or other electronic device providing Internet connection,
b. a web browser that supports cookies,
c. e-mail address.
3. Registration and conclusion of the contract
In order to register at ravonmanufactura.com, you must complete the registration form by providing the following data: e-mail address and password. A message will be sent to the Customer's e-mail address provided in the registration form, indicating how to confirm the registration and other information required by law. Upon confirmation of registration, an agreement is concluded between the Customer and RAVONMANUFACTURA.COM, the subject of which are the services provided by RAVONMANUFACTURA.COM, on the terms specified in the Regulations. The conclusion of an agreement with the Customer for the use of ravonmanufactura.com takes place upon confirmation of the correctness of their e-mail address. From that moment on, the Customer's personal data are processed on the basis of art. 6 sec. 1 letter b of the GDPR.

In the case of a legal person and an organizational unit without legal personality, all actions of this entity on ravonmanufactura.com may only be performed by a person who is authorized to perform on behalf of this entity all actions related to the use of ravonmanufactura.com and to exercise all rights and obligations of this entity as a Customer.

Concluding Agreements without prior registration at ravonmanufactura.com is possible, subject to the remaining provisions of the Regulations, after meeting all of the following conditions:

a. correctly completing the electronic web form available on the ravonmanufactura.com website by providing the following data: name, surname, e-mail address, contact telephone number, delivery address.
b. acceptance of these Regulations.
c. reading and accepting the privacy policy or information obligation. The personal data of a customer making a purchase without registration will be processed on the basis of art. 6 sec. 1 letter b of the GDPR for a period not longer than indicated in art. 70 § 1 of the Tax Ordinance.
4. Services provided by RAVONMANUFACTURA.COM
RAVONMANUFACTURA.COM enables the Customer to use the following free services:

a. the possibility of placing orders at RAVONMANUFACTURA.COM to purchase products,
b. the possibility of creating a Customer account by registering in accordance with points 3-5 of the Regulations and storing and making available to the Customer via the Customer Account the history of concluded Sales Agreements with RAVONMANUFACTURA.COM,
c. the possibility of using contact forms (a service consisting of providing a contact form for sending messages to the Service Provider. The use of contact forms and the provision of personal data via them is voluntary and is solely used to process the user's inquiry),
d. subscription to the newsletter, i.e. ordering the sending of current information about promotions and news related to the assortment of the online store to the e-mail address indicated by the Service Recipients. In order to order the newsletter, the Customer provides their e-mail address and their name (optional) in the Newsletter subscription form available on the store's website. In order to order to receive commercial information, the Service Recipient is also obliged to read the Privacy Policy, available on the online store's website, and confirm that they have read it. Information received as part of the newsletter, in particular information on the prices applied, does not constitute an offer to conclude a contract within the meaning of the Civil Code. Data sent as part of the newsletter is for informational or marketing purposes only. The Customer may unsubscribe from the newsletter at any time by clicking on the unsubscribe link in the footer of each newsletter sent.
Additionally, for Customers who have set up a Customer account, RAVONMANUFACTURA.COM provides the following types of services free of charge:

a. storing and sharing the history of concluded Sales Agreements and placed Orders via the User Account,
b. ongoing update of the status of the placed Order.
If the Customer is found to have violated the provisions of the regulations regarding the provision of services by electronic means, RAVONMANUFACTURA.COM, after a prior ineffective request to cease or remove the violations and setting a deadline, may terminate the agreement for the provision of services by electronic means with a 14-day notice period.

The Client undertakes to comply with these Regulations. The Client is obliged to comply with the prohibition of abusing electronic means of communication and providing the following content through or to ravonmanufactura.com IT systems:

a. causing disruption or overload of the IT systems of ravonmanufactura.com or other entities participating directly or indirectly in the provision of services by electronic means,
b. infringes the rights of third parties, generally accepted social norms or is inconsistent with generally applicable legal provisions.
5. Products and prices
All products available at ravonmanufactura.com are brand new, free from physical and legal defects, except for so-called outlet products, the possible defects and damages of which are disclosed in the description of a given product. Regardless of the above, all products at ravonmanufactura.com have been legally introduced to the Polish market.

All prices listed on the ravonmanufactura.com website are gross prices (include VAT). An invoice is issued for each sold product.

6. Placing orders and payments
In the case of an order placed in the ravonmanufactura.com store, the Customer makes a purchase by using the "Order and pay" button (for Online Payments) and "Confirm purchase" (for other forms of Payment).

The customer is obliged to pay the price for the goods ordered at ravonmanufactura.com, including delivery costs, no later than 3 days from the date of completion of the order, provided that payment is made on delivery.

The following forms of payment are possible:

Upon receipt – payment in cash to the courier or at the cashier of the personal collection point. In selected cases, RAVONMANUFACTURA.COM reserves the right to additional telephone verification of such orders.
By bank transfer - a form of payment for customers who prefer to log in to their online bank, visit a bank branch or post office. After placing an order, the customer receives a bank account number via e-mail, to which the appropriate amount should be transferred. Once the payment is credited to the RAVONMANUFACTURA.COM bank account, the order is transferred to the warehouse for completion and preparation of shipment.
Online transfer – an electronic payment method supported by [payment service provider].
By payment card (Visa, Mastercard) - each card payment transaction is securely authorized by [payment service provider]. Once the payment is confirmed, the order is transferred to the warehouse for preparation and shipping.

In the case of certain types of products available on ravonmanufactura.com, RAVONMANUFACTURA.COM reserves the right to limit the method of payment by not providing certain payment options referred to in paragraph 3 above – relevant information in this regard will be included in the description of the product.

7. Order fulfillment and delivery
The ordered goods are delivered using our own transport as well as specialized courier companies. Personal collection of products is possible only at the RAVONMANUFACTURA.COM headquarters, at the address: Kraszków 100, 26-300 Kraszków.

The Customer shall bear the costs of the selected delivery method specified in the Transport Price List provided at ravonmanufactura.com in the "Types and costs of delivery" tab, which depend on the size and weight of the ordered product and are visible to the Buyer in the shopping cart and calculated precisely before placing the order.

In the event of significant differences in the time of execution or the method of packaging and delivery of individual products, which make up a single order placed within ravonmanufactura.com, RAVONMANUFACTURA.COM may decide to divide the order into smaller shipments. In such a case, the total delivery cost given to the Customer when placing the order may change, provided that this will happen after prior contact with the Customer and after their prior acceptance of the changes in question. In the event of the Customer not accepting the agreement referred to in the previous sentence, they may withdraw from the contract in whole or in part. In the event of cancellation of part of the order, the delivery costs that were assigned to the undelivered or complained part of the order are corrected. Each product offered has an approximate order completion time, which is no more than 30 days from the date of conclusion of the agreement, with the exception of "made to order" products, the delivery time of which may be longer, about which the Customer is informed. It informs how many hours/working days usually elapse from the moment the Customer confirms the order until the ordered product is prepared and shipped. An order for products with different completion times is sent after the entire order has been completed, i.e. after the longest of the times given for the ordered products. In the event of splitting the order, individual shipments may be sent at different times, about which the Customer is informed by e-mail. If the completion time turns out to be longer than indicated, then RAVONMANUFACTURA.COM contacts the Customer to inform about the delay and confirm further willingness to complete the order. The deadline for receiving the shipment is always the time of completing the order increased by the delivery time. In the case of payment by bank transfer, the above deadline is additionally extended by the time of making the transfer to the bank account indicated by RAVONMANUFACTURA.COM, and in the case of payment by card, by the time of payment authorization.

In the case of personal collection, the parcels are delivered to the RAVONMANUFACTURA.COM headquarters, at the address: Kraszków 100, 26-300 Opoczno. RAVONMANUFACTURA.COM informs about the possibility of collecting the ordered product by e-mail. The parcel should be collected within 5 days of receiving information about the possibility of collecting the product. The parcel that is not collected within the specified time will be sent back to the warehouse and the order will be canceled. The place of fulfillment of the service related to the purchase of products at RAVONMANUFACTURA.COM is the address of the company's headquarters.

8. Returns and complaints
Standard products (white from stock) may be returned within 14 calendar days of delivery without giving a reason, provided that the return costs are borne by the Customer. Personalised products, including products in colours other than white and products from the Ravon Art limited series, are non-refundable.

The products have a manufacturer's warranty, valid in Poland. The manufacturer's warranty period and conditions for each product are listed in its description on the ravonmanufactura.com website. The detailed terms of the manufacturer's warranty are specified in the warranty form issued by the guarantor. Most products have warranties that are implemented directly by authorized service points of the manufacturers. The exact addresses of service points are on the warranty cards attached to the products and on the manufacturers' websites. The warranty for the sold consumer goods does not exclude, limit or suspend the buyer's rights resulting from the warranty for defects in the goods or the lack of conformity of the product with the contract.

In the event of the Customer wishing to exercise the rights granted by the manufacturer of the goods, RAVONMANUFACTURA.COM enables the Customer to fill in and submit the "Complaint Form" available at ravonmanufactura.com under the heading "Complaints" in the "Help / After-sales Service" tab. Information on the method and procedure for handling the guarantee will be provided to the Customer by RAVONMANUFACTURA.COM in correspondence, which will constitute a response to the previously submitted "Complaint Form".

A complaint may be submitted, for example, by completing the electronic complaint form available on the store’s website at the link: [Link to complaint form], in electronic form to reklamacje@ravonmanufactura.com, in writing to the following address: RAVONMANUFACTURA.COM, Kraszków 100, 26-300 Opoczno.

The Product may be sent or returned under the complaint to the following address: RAVONMANUFACTURA.COM, Kraszków 100, 26-300 Opoczno.

It is recommended to include in the complaint: (1) information and circumstances concerning the subject of the complaint, in particular the type and date of the irregularity or lack of compliance with the Agreement; (2) a request for a method of achieving compliance with the Agreement or a declaration of a price reduction or withdrawal from the Agreement or another claim; and (3) contact details of the person filing the complaint - this will facilitate and speed up the consideration of the complaint. The requirements given in the previous sentence take the form of a recommendation and do not affect the effectiveness of the complaint without the recommended description of the complaint.

If the complainant needs to change the contact details provided during the complaint consideration process, the complainant is obliged to notify the Seller thereof.

The person filing the complaint may attach evidence (e.g. photos, documents, recordings) related to the subject of the complaint to the complaint. The seller may also ask the person filing the complaint to provide additional information or send evidence (e.g. photos), if this will facilitate and speed up the process of considering the complaint.

The Seller will respond to the complaint immediately, no later than within 14 calendar days from the date of receipt of the complaint.

9. Final provisions
The information on the ravon-manufactura.com website does not constitute an offer within the meaning of the Civil Code. By placing an order using the mechanisms available on the ravon-manufactura.com website, the customer makes an offer to purchase a specific product under the terms specified in the product description.

RAVON-MANUFACTURA.COM collects and processes personal data provided by Customers in accordance with applicable legal provisions, in particular the General Data Protection Regulation (OJ EU L 119 of 4.05.2016, p. 1) and in accordance with the principles set out in the Privacy Policy, which constitutes Annex No. 2 to the Regulations.

RAVON-MANUFACTURA.COM may change the Regulations and launch a new version of the services provided within ravonmanufactura.com. The change becomes effective on the date indicated by RAVON-MANUFACTURA.COM, which may not be shorter than 7 days from the moment the amended Regulations are made available on ravonmanufactura.com, provided that orders started before the changes enter into force are conducted on the previous terms.

The customer will be notified of such changes and the possibility of accepting them upon their first login to ravonmanufactura.com after the changes come into effect. Refusal to accept the changes is tantamount to termination of the agreement with RAVON-MANUFACTURA.COM.

In unregulated matters, Polish law shall apply.

Any disputes related to services provided by RAVON-MANUFACTURA.COM within ravonmanufactura.com will be resolved by common courts. A customer who is a consumer has the option of using an out-of-court method of handling complaints and pursuing claims before the Permanent Consumer Arbitration Court at the Provincial Inspectorate of Trade Inspection [appropriate venue]. Information on how to access the aforementioned mode and procedures for resolving disputes can be found at the following address: www.uokik.gov.pl, in the "Resolving consumer disputes" tab.

In accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on ODR for consumer disputes), we hereby provide an electronic link to the ODR platform: https://ec.europa.eu/consumers/odr/.
